We want fairness, and in that fairness we want those who are more powerful to be punished more when they use that power to harm. We want this because of a concept of fairness called “fairness as justice” which is just a compact way of saying that Uncle Ben is right and when you fail to uphold your responsibilities the Just thing is that the consequences of that has to be commensurable with the power that led to you having those responsibilities in the first place.
Physical force is power, and for that reason we should be writing laws that penalize people with martial skills more than those without. Beat someone to death and have a black belt or are a MMA fighter? Serve more time than an untrained person. Etc.
Wealth is power, and for that reason we should be writing laws that issue fines as a percentage of wealth or income, not a fixed price. Drive while drunk? Pay a fine equal to 10% of your income last year. Etc.
Influence is power, and for that reason we should be writing laws that include locking influencers out of the system. “Yell “Fire!” in a crowded theater” on the Internet? You can’t touch a computer or smartphone or be in front of a camera or mic for a year. Etc.
Culture is power, and for that reason we should be writing laws that include penalizing brands with export controls, advertising blackouts, and blackouts. Found guilty of corporate malfeasance? No advertising for 12 months. Or, no exports to foreign markets. Or, No new releases for 1 year. Etc.
Authority is power, and for that reason we should be writing laws that include higher bars for conduct and higher penalties when convicted. Prison guard that raped an inmate or cop who kills a cooperating perp? Double the minimum time served. Politician or judge that breaks the law? Triple the minimum time served. Etc.
